Canada accused of unlawfully hounding Human Rights activist @ 26 May 2015
A Canadian human rights activist is accusing the Canadian authorities of unlawful harassment and persecution after his passport was seized and a restraining order barred him from seeing his two children.

Kevin Galalae 50, is a naturalised Canadian who was born in Romania and grew up in Germany, the son of Dr. Costel Galalae, a physician and political dissident who was convicted to five years in prison for challenging Caucescu's government.

The wikispooks website states: “In 1981, Galalae, his twin sister (Irina), his mother, and his older brother (Razvan) traveled to France, from where they sought political asylum in Germany, settling in Hamburg. Galalae’s younger brother (Daniel) and his father were held back by the communist government for 2 and 6 years respectively before they could be reunited with the family in Germany.

“Kevin Galalae immigrated to Canada in 1985, aged 19, became a naturalized Canadian in 1991, and received a scholarship from St. Jerome’s High School in Kitchener, Ontario, where he graduated with the distinction Ontario Scholar in 1986. In the summer of 1987, Galalae engaged in a hunger strike for seven days in Victoria, to encourage the Canadian government to process his application for landed immigrant status so he could begin his university studies and not have to pay triple tuition fees as a foreign student.”

In addition to the Canadian hunger strike, in 2011 Galalae staged a 30-day hunger strike outside the Council of Europe in Strasbourg to protest the UK Government’s Surveillance and censorship program, which he became aware of after studying at universities in the UK. He also staged a 46-day hunger strike in 2014 outside the Vatican to protest covert depopulation. He claims to have uncovered evidence of a global plan to depopulate the planet and has written several books documenting his research.

His Canadian passport was seized on re-entering Canada on 21 April 2015, he said, under the pretext that he had “it
had been reported lost or stolen”. He had been returning from a year spent in Europe where he had staged a 46-day hunger strike at the Vatican to compel Pope Francis to help shut down all covert methods of population control. While in Europe he also published scientific evidence of global genocide in a 1050-page book of evidence entitled Peace Without
Poison

Despite providing certified copies that he is the rightful owner of the passport and that it was never lost or stolen it has not been returned to him. 

He found his wife and children missing from his home in May 2011 after he returned home from France following a 30-day hunger strike at the Council of Europe and the European Court of Human Rights in Strasbourg,  to try to compel the European authorities to shut down a covert program of surveillance and censorship in Britain and the E.U. 

Mr Galalae said: “Their abduction was accomplished with my wife’s cooperation with the Canadian authorities under the pretext that I pose a danger to my wife and children because I show, according to the police synopsis, “obsessive delusional behavior” and hold “bizarre ideologies”.”

After tracking down their wherabouts he called to visit but was refused entry to the house and access to his children and police were called. Although, according to one police officer’s statement, no grounds existed to arrest Galalae, another of the responding officers openly stated that he wanted to arrest Galalae and subject him to a psychiatric assessment.

Galalae volunteered to undergo a psychiatric assessment and also provided several independent assessments and reports which contradicted authorities’ claims that he was of unsound mind.

Fearing unlawful arrest and detention, he fled Canada by crossing the St Croix river at night to the United States, from where he continues to fight his case and seek asylum.

He says he was not afforded the right to respond to his partner Cynthia Marshall’s application to the courts for a restraining order, which he said was served upon him without any reasonable grounds for its implementation.

Mr Galalae said: “I have not seen my children in four years. I was forcibly separated from them in May 2011 and prevented from attending family court by repeated arrests (seven to date) for invented criminal charges, charges intended to deny me my children and property, neither of which have been returned to me. 

“During my sixth pre-trial detention, which lasted nine months and ended in my release on 11 September 2013 when all charges were dropped or stayed the day before the criminal trial was set to begin, I was given a ten-year restraining order that is completely unjustified and illegal since I was not given the opportunity to be in court and no reason was given as to why I should be prevented from being with my children for a single day let alone ten years.”

In an affidavit to the court, Marshall claimed Galalae had ‘emptied’ their joint bank account before travelling to Europe to go on hunger strike, leaving her destitute. Galalae said that was false as he only took money from his own account and not from Marshall’s.

In a police officer’s report obtained by Galalae and signed by Officer Krista Lowe who attended Marshall’s address while Galalae was attempting to visit his children, Lowe states:

“While I was speaking with the family, PC Gemignani was speaking to S/Sgt Sands, who apparently advised PC Gemignani that if we could locate GALALAE, we were 'to apprehend him under the Mental Health Act’.

“At this point, I advised PC Gemignani that I did not have grounds to arrest GALALAE under the Mental Health Act. PC Gemignani tried to contact GALALAE by cell phone. GALALAE was at the Cineplex movie theatre. PC Gemignani requested that GALALAE meet with us and he agreed.

“PC Gemignani advised MARSHALL that he had located GALALAE and that he would apprehend him under the Mental Health Act.

“While enroute to the movie theatre, I contacted Sgt Borel and advised her that I had no grounds to apprehend GALALAE under the Mental Health Act. During this time, PC Gemignani was speaking with GALALAE at the theatre.

“PC Gemignani then advised me that GALALAE was willing to go to the hospital voluntarily, as he wanted to clear any doubt that he needed help.

“GALALAE was transported to the hospital by PC Gemignani. Enroute to HDH, I was advised by dispatch that Detective Diane McCarthy would be meeting us at the hospital. Sgt. Borel advised me that I would be able to apprehend GALALAE based on Det. McCarthy's assessment, should that need arise.

“At HDH, Det. McCarthy informed me that if GALALAE wasn't formed by the doctors, she would like us to arrest him criminally so that he would be able to get an assessment at Quinte.”

Lowe’e report concludes:

“The next day, I was advised y PC Gemignani that GALALAE had been released from the hospital by psychiatry, as they did not feel an assessment was necessary.”

Galalae meanwhile continues to fight to draw attention to the repressive activities of the Canadian authorities, to retrieve his passport and to rescind the unlawful restraining order preventing him having contact with his children.
