Tueday's unanimous decision of the Supreme Court shows how the Government has a 'cavalier attitude to the rule of law', said Malachy Steenson, Solicitor and Criminologist and a Campaigner for a No vote in the Children's referendum.

He was speaking following the delivery of the full Judgment of the Supreme Court in the successful challenge by Mark Mc Crystal to the government's referendum campaign.

Mr Steenson said: "The Judgment of the five most senior Judges in the Country was that the Government's information campaign was not fair, neutral and impartial and that its conduct amounted to clear disregard of the limits on the acts of the State."

"In his Judgment Murray J., concluded that what was done was done with the aid of public funds, to the disadvantage and detriment of those making the case for a No vote.

"In the aftermath of the initial Judgment on the 8 November Government spokespersons were at pains to point out that the Booklet and website were approved by the Attorney General, an attempt to lay the blame at her door, Fennelly J. (at para 43) in his Judgment finds that the State in its case did not assert that the AG had approved them, he found that the AG's advise amounted to two sentences.

"It is clear that Ministers Fitzgerald carries the responsibility for the unconstitutional action of her Department and the wasting of over €1.5m including the legal costs now due, The Minister should even at this late point do the honorable thing and resign."

He concluded: "The reality in this State now is that the Supreme Court can be ignored by the Government with immunity and as usual nobody is ever accountable here."
